This is a piece published on 'The Bookseller' website today: AMAZON SEEKS PERMISSION TO OPEN A 'NEW CANADIAN BUSINESS' Amazon is seeking to set up a physical base in Canada, The Bookseller can reveal, and has applied to the government to open a "new Canadian business". The move could lead to a huge shake-up of Canada's book trade. Amazon.com does not have a physical operation in the country, but sells books through its domain Amazon.ca. Moving into the country would mean the company could ship to Canadian consumers more quickly and cost-effectively. But to operate there, Amazon must receive permission from Canada's heritage ministry. The application is subject to a confidential inquiry by the Canadian government, which will assess whether it breaks Canada's tough cultural protection rules, which are designed to prevent American influences from overpowering Canada's culture. According to Privy Council documents seen by The Bookseller, an inquiry ordered by Canada's governor general (The Queen's representative in the country) under the Investment Canada Act will probe "investment by Amazon.com Inc to establish a new Canadian business carried on by Amazon Fulfillment Services Canada Inc". Amazon spokesperson Mary Osako confirmed that an application had been made, but declined to say what it planned to sell through the new company and services. "We're always looking for new ways to serve our Canadian customers, but it's premature to discuss our plans as we await a ruling on our application," she said. Amazon's proposal was issued on 27th January, and could take 45 days to "determine if it will be of direct cultural benefit to Canada", according to Tim Warmington, media relations officer for Canadian Heritage. He declined to offer more details, as the information is protected by the Investment Canada Act. The move could prove to be a boon to Canadian publishers, but it would also hit the country's retailers. Dominant Canadian bookseller Indigo declined to comment. Carolyn Wood, director at the Association of Canadian Publishers, said: "There's a belief that Canadian-owned retailers will be more likely to promote Canadian books," Wood said. "(Amazon) presumably will have to commit to a business model that proves it is in net benefit to Canadians." But Wood said it would be difficult for Indigo's online business, indigo.ca, to compete with a Canadian-based Amazon. "It has been difficult to compete with Amazon.ca as it is," she said. "It will be a challenge." Amazon launched its Canadian site in June 2002, amid protests from Canadian booksellers who argued that the online store violated regulations that prohibit foreign ownership. This is a piece published on 'Irish Publishing News' website today: 2009 WORST YEAR FOR THE TRADE – EASON MANAGER The manager of Eason’s flagship store on O’Connell Street in Dublin has spoken this morning about the book trade following the closure of Hughes & Hughes on Friday. Speaking on RTE Radio 1’s The Marian Finucane Show, Martin Black said: ‘I’ve been in the bookselling business for over 30 years and certainly everyone agrees that 2009 was the worst year we’ve ever experienced.’ As part of a panel, which included former supermarket retailer Feargal Quinn, Mr Black talked about rents, book selling and how the recession has affected the Irish market. Mr Black Said: ‘Bookselling is a very difficult business. It’s different to other retailers in the sense that in the drapery business you can get stock in, hold it there for a few months, but on a daily basis there are new titles coming in. One never knows how they are going to go, it’s like throwing wet cement on a wall you don’t know what is going to stick, what the bestseller is going to be and you’ve got to buy in the hope of what you think will appeal.’ Turning to Hughes ad Hughes, Mr Black said he believed that the airport shops were still ‘profitable’. Addressing the issue of rent, which was a factor Hughes and Hughes cited as a cause for its collapse, Mr Black said: ‘if a company is in a rental situation and you’ve got upward demands of rent of nearly 100%, it’s very hard to cope with that’. This is a piece published on 'The Bookseller' website today: HIGH STREET LOSES TWO INDEPENDENT BOOKSHOPS A WEEK Independent numbers dwindled last year with almost two shops closing a week and Booksellers Association figures revealing the biggest net closure since 2004. During a tough trading year in 2009, 102 indies closed and just 40 opened, meaning there are 62 fewer indie bookshops than there were in 2008. The figures include those who have joined the BA for the first time and those who have cancelled their membership. According to the BA, there were 1,289 indies at the end of 2009. Meryl Halls, head of membership services at the BA, said: "There is no doubt that we are living in an incredibly tough economic climate from which no bookselling sector is immune." Halls said the BA has "a huge variety of initiatives and programmes in place to assist the independent sector". These include the Independent Booksellers' Forum, Independent Booksellers' Week and the introduction of the IndieBound marketing initiative. Halls added: "There is wonderful evidence of good practice among so many independent booksellers—those booksellers who work so hard to be successful generally stand out from the crowd". Nick Bubb, retail analyst at Arden Partners, predicted another tough year for independents. "It is a trend that is hard to stop, every year Amazon and Play.com get bigger and better at books." Bubb added supermarkets' book range would also affect independents and he believed shops would continue to close. Bubb said indies would have to "promote hard [and] generate loyalty" in order to survive. But some indies suggested the BA was not doing enough to protect the sector, which could also affect membership. The BA declined to give figures for those who had left the organisation rather than closed down. Dinah Anderson, owner of Bookshrop in Shropshire, said she would be "seriously" reviewing her BA membership this year. "We're being depleted, being attacked from all sides and now with the Book Tokens that was the last thing we had left that was ours." She added that indies would not survive unless they got some "explicit support". During 2009, closures have included Crockatt & Powell in Waterloo, south London, Lost in Fiction in Edinburgh and crime indie Murder One in central London, which shut last January after 21 years. This is a piece published on 'The Bookseller' website today: BORDERS' UK CRASH LEAVES £40M UNSECURED DEBT Borders UK’s unsecured creditors could receive as little as 1.5p in the £1, with just £600,000 ring-fenced to pay what is estimated to be in excess of £40m-worth of debt. Publishers, who were confident of having their £10.8m debts largely repaid in full last year, have so far received £2.2m due to successful retention of title (ROT) claims. The figures are contained in the creditors’ report for the business seen by The Bookseller, and are based on the original estimates of the company’s directors. The debt figure does not take into account any reduction should new tenants take up surrendered leaseholds, or ROT claims. Borders’ administrator MCR said “a commercial settlement” had been reached with most suppliers, though the situation with Hachette UK, which took the administrator to court last year in order to have its ROT enforced, was ongoing. MCR realised a surplus of £1.3m from £12.2m of sales during Borders’ administration period. A further £14m income is expected to come through, but it is not known how much will be left after further outgoings, which could include more ROT payments. Staff have already been paid for hours worked—from the £12.2m—however, redundancy and notice pay are not expected to be covered. Geoffrey Bouchier, joint administrator, said it was unlikely the final surplus would reach the £14.5m owed to Valco, which takes priority in being repaid as the ranking secured creditor. A second secured creditor, Bookshop Acquisitions Ltd (BAL), owed £12.4m, is unlikely to receive anything. “At the moment we don’t anticipate any distribution to BAL,” said Bouchier. “Based on the numbers we have seen, it is not expected that secured creditors will be fully paid, so there will be no general money left to pay the preferential unsecured claims [which includes publishers].” The report revealed that Borders UK went into administration following a winding-up petition served on the business by 2 Entertain Video in November. In the period from February to 26th November, the retailer made a loss of £32m on sales of £115m, and a loss of close to £5m on sales of £190m in the year to end-January 2009, though this performance was actually an improvement on its previous three years trading. The report also makes plain that Borders’ stock control systems were inadequate to deal with ROT claims, with Bouchier saying stock identification had been difficult because “the Borders system was not up to scratch, was not reliable, there were flaws across the board”. Bouchier said: “I believe that we dealt with suppliers as fairly as we could. We have reached commercial settlements with the large majority of publishers, certainly the very large ones, and we are happy with the deals we have reached.” Among those with the biggest exposure were HarperCollins (£1.1m), Macmillan Distribution (£885,000) and Gardners (£885,000 across all divisions). Hachette UK was not listed. But the figures do not include settled ROT claims, meaning that the actual losses could be considerably less. Neither Gardners nor Macmillan could be reached for comment. A HarperCollins spokesperson said much of the debt was to third-party publishers represented through its distribution arm. “After taking into account recoveries from the administrator, our net debt write-off following Borders going into administration was relatively small," she added. A creditors’ meeting will be held if requested by enough creditors. MCR said it had 150 expressions of interest in the company, though none of the offers received were for the business as a going concern. MCR expects to earn £670,000 in fees from the administration. This is a piece published on 'The Bookseller' website today: CELEB MEMOIRS 'HERE TO STAY' Publishers believe the celebrity memoir is "here to stay" despite a poor performance last year, with new titles from Keith Richards, Michael Caine and Katie Price in the pipeline for 2010. Last year was a disappointing year for the celebrity market with titles by Ant and Dec and Peter Kay not meeting the high sales of previous years. When Waterstone’s m.d. Gerry Johnson left the business earlier this month, celebrity flops were cited by the mainstream press as one reason for its slump in sales. For 2010, however, publishers have forecast a fruitful yield from the crop of celebrity titles with books due from the likes of Michael McIntyre (Penguin) and Michael Parkinson (Hodder). Orion will publish Rolling Stone Keith Richards’ autobiography later this year. “They don’t come bigger than this,” said Lisa Milton, managing director of Orion Trade. Michael Caine’s memoir is also being tipped as a Christmas hit, with its release due in the autumn. Rowena Webb, director of non-fiction at Hodder & Stoughton, said: “We certainly do think the celebrity memoir is here to stay . . . people are looking for strong stories, big careers and very often people who can write themselves. Those people who span the generations, books that the whole family can gather around and listen to.” At the age of 31, Katie Price is releasing her fourth memoir in seven years. I’m Still Standing will be published by Century in October. Publishing director Ben Dunn said despite the number of previous autobiographies, the title would still sell well. In the two- and-a-half-year gap since her last book, “an awful lot” had happened, he said. “Her life is the most extraordinary roller-coaster. She really is unique,” said Dunn. Others are also hoping for success this year with second memoirs including a new title from Russell Brand (HarperCollins), a follow-up to his 2007 hit My Booky Wook (Hodder) and Paul O’Grady with his new book The Devil Rides Out (Bantam). But Caroline Mileham, head of books at Play.com, was sceptical about the strength of follow-ups. Last year Peter Kay’s Saturday Night Peter failed to match the success of his 2006 hit The Sound of Laughter. She said: “When it is a second or third book they don’t have the same weight and they don’t do as well. Ideally for me there would be one really well written instead of lots.” Webb at Hodder said the decline in sales of sequels to successful memoirs was a “slight cautionary tale for publishers”. This is a piece published on 'The Bookseller' website today: UK PUBLISHES MORE BOOKS THAN EVER IN 2009 Last year saw the largest number of titles published since records began 15 years ago, Nielsen Book figures have shown. The UK publishing industry produced more than 133,000 titles during 2009 - an increase of 3.2% on the previous 12 months - hitting the highest output for a single year ever. When Nielsen first began collating the data, the UK produced fewer than 100,000 titles a year. The highest until now had been 14 shy of 130,000, a figure reached in 2003. Nielsen said: "The increases can be accounted for in part by growth in print-on-demand (POD) and digital product, which we expect to continue to increase in the future." English-language titles recorded by Nielsen Book as having been published somewhere in the world, excluding UK and Ireland, have also grown exponentially, with 2009 showing a record 604,768 publications. The new book production figures have also increased the overall number of bibliographic records held on the Nielsen Book database to 10.4m globally and 5.8m for UK & Ireland. This is a piece published on 'The Bookseller' website today: HIGH STREET BOOK SALES FROZEN AT WORST LEVEL IN NINE YEARS High street book sales fell to their lowest for nine years, as heavy snowfalls and icy pavements kept shoppers at bay, according to Nielsen Bookscan data. The wider Total Consumer Market, which also includes book sales from internet retailers, reported its worst week for more than 18 months. It fell 13.3% on a week-on-week basis, to £24.4m — the lowest level since conversely hot weather kept buyers from the tills in May 2008. Meanwhile the General Retail Market — which includes sales from the likes of Waterstone’s and W H Smith — plummeted 33.1% to £12.5m, its lowest weekly revenue figure in more than nine years. Both markets were down year on year, by 15.1% (TCM) and 20.4% (GRM). However, it was not bleak time for everyone. Stephenie Meyer passed the one million mark with her hardback Breaking Dawn (Atom), unmoving at third in the charts. Hers is only the eighth hardback to have achieved this feat since TCM began in 2001, joining JK Rowling, Dan Brown, Delia Smith and Lynne Truss. Fellow adaptee The Lovely Bones by Alice Sebold (Picador) also rose up the charts, from 57th to 35th place. But Dan Brown dropped 12 places this week, with his worst week of sales since The Lost Symbol (Bantam Press) was published in September. This being the season of abstinence, a handful of new year-new you titles have made it into the top 50. This is a piece published on 'The Bookseller' website today (on Neill Denny's Blog, Neill is the editor-in-chief of The Bookseller): TOUGH YEAR AHEAD FOR THE BOOK TRADE Christmas, indeed the whole of 2009, will go down as the narrowest of narrow squeaks with the market overall down a mere 1.2% by value, and just 0.5 % by volume. In a calendar year that has seen the UK economy contract by almost 5%, that is no mean performance and proves once again that the book trade is recession-resistant, if not entirely recession-proof. But that reasonably optimistic overview is to ignore the real signs of distress coming from key parts of the trade. The first is high street bookselling, where the collapse of Borders and Wesley Owen late last year were symptomatic of a sharp decline. Nielsen’s General Retail Market measure, the closest thing we have to a pure high street sales monitor, showed sales value falling by almost 7%. The reasons high street bookshops are falling out of favour with many customers can be easily summarised: the internet has wider range, and the supermarkets are cheaper and more convenient. The publishers have taken a pounding too. The weaknesses of the hardback non-fiction fiction market have been pored over, although our detailed look at the market on page 18 shows the death of the celebrity market has been somewhat exaggerated. A weak “Richard & Judy” performance in 2009 was therefore doubly unfortunate, and, although there were successes from Dan Brown, Stephenie Meyer and Hilary Mantel, these were only local bright spots against a more sombre backdrop. So the trade enters 2010 in a slightly battered state, and it would be foolish to assume any rapid improvement. Indeed, in the short term, things will quite probably get worse. The first post-Christmas week showed the market down by almost 10%. The rest of the year looks equally discouraging. A pivotal general election, which may well see only the second change of governing party since 1979, will distract the serious book-buying public in the spring. Dan Brown and Stephenie Meyer have shot their bolt, and if Richard and Judy do put together a show to rival Amanda Ross’ Channel 4 book strand there is a very real risk that the public will be confused and turn off both. Perhaps only the unlikely event of England lifting the World Cup could provide a mid-year boost. Although the broader economic picture looks better than a year ago, post-election tax rises will sap consumer spending. All this, and digital too. This is a piece published on 'The Bookseller' website today: JANUARY SALES FAIL TO SPARK GROWTH AS PRICES TUMBLE January sales have had book-buyers flocking to the high street but post-Christmas sales are down on last year. In total, £28.2m was spent at UK book retailers, including online, last week - down 26.6% on the previous week and 9.7% year on year. The high street performed slightly better, with sales through Nielsen BookScan's General Retail Market, a strong indicator of high street bookshop performance, down a shallower 7%, to £18.6m year on year. The bestselling book of the week ending 2nd January was Pedigree's The X Factor Annual. However, because it sold for just £2.39 on average - 81.6% off its £12.99 r.r.p - it, along with numerous other titles, is excluded from The Bookseller's official bestseller lists this week—which contain any title not discounted by more than 65%*. In total, 25 titles that sold more than 5,000 copies last week were discounted by more than 65% on average, up from 15 in the comparative week last year. Of the 25, 12 sold more than 10,000 copies through BookScan's Total Consumer Market, and all of them are annuals—including the likes of The Beano Annual (22,449 copies sold at 73.7% off its £7.99 r.r.p.) and The High School Musical Annual (18,033 copies sold at 79.6% off its r.r.p.). With deep-discounted stock excluded from the charts, Stephenie Meyer takes the top three positions. Her third Twilight novel, Eclipse (Atom), takes top spot with a 27,059 sale, while Twilight (20,231 copies sold) and Breaking Dawn (19,144) take second and third position respectively. James Patterson's Run for Your Life (Arrow) takes fourth with the mass-market edition of Meyer's New Moon in fifth. This week's highest new entry is Sarah Waters' The Little Stranger. The Man Booker shortlistee is the first member of Channel Four's forthcoming "The TV Book Club". It sold 11,715 copies last week—strong enough for 12th position overall. The firm's rival Play.com came second in the survey, which saw overall customer satisfaction improve by 6% on last year. Waterstone's came in tenth, while W H Smith was 25th. The index, compiled by market research consultancy ForeSee Results, rates customer satisfaction according to four factors - functionality, price, merchandise and content. The study took account of 10,000 responses from shoppers who visited the top 40 retail websites in the UK in November and December. Larry Freed, chief executive of ForeSee results, said: "While these numbers are certainly a huge step in the right direction, companies who saw improvements run the risk of being lulled into a false sense of security. "There is still a long way to go with the UK's numbers still trailing the US by 10%. Additionally there is only one site out of 40 with a satisfaction score over 80, Amazon— essentially an American company with a strong UK presence. "It concerns me that there are still 15 companies scoring 60 or lower which means they are risking sales and market share to better performing companies." This is a piece published on 'The Bookseller' website today: DISCOUNTING AND RECESSION MAIN TREATS IN 2010, WARN INDIES Deep discounting and the continuing recession are the main threats to independent booksellers according to The Bookseller's Christmas survey. But there was also confidence among the 40 respondents that "proper bookshops" would continue to attract book buyers. Gary Kingdon of Burnley-based Badger Books said the main threats to his shop would "come from the deep discounting offered by competitors (that must be subsidised by the publishers)". He added: "I will be extremely happy if I am still here in a decade. I am thinking year to year, rent to rent at the moment." Competition from cheaper online retailers was identified as a key concern for many. Peter Tillotson of The Book Case said independents would "need to work out how to survive alongside Amazon as the personal service we offer is no longer a substitute for the convenience of shopping on-line". Tillotson reported Christmas sales down 9%, with shop's customer order down 15%, adding: "Customers who did not always find what they were looking for on the shelves openly admitted they would shop on Amazon." Meanwhile, a response from Wenlock Books said it was "difficult to be optimistic about the industry given the utter madness of the discounting mess. When our supply dries up because no one can afford to publish quality, serious, excellent books - then that's the end of bookselling". But Bob Johnston of The Gutter Bookshop in Ireland said he was "fluctuatingly optimistic". He added: "We'll be here in 12 months time but it's going to be tough. There will continue to be a good market for printed books but e-readers and e-book downloads will begin to make an impact." Other indies were more positive. John Hudson from the Fordingbridge Bookshop said he was "fairly bullish", adding "more customers are returning to 'proper bookshops' where service (knowledge, range and speed of delivery) are moving further ahead of the 'variety stores' selling books. This is a piece published on 'The Bookseller' website today: CHRISTMAS TOO CLOSE TO CALL FOR 'UNPREDICTABLE' BOOK TRADE Christmas 2009 is still impossible to call booksellers have said, describing the trading environment as "unpredictable" and "volatile" with sales of the bestselling titles well-down on last year and the market in general still below last year's levels. Booksellers have reported a slight improvement in this week's trading, compared with last week. But the Christmas Number One - Dan Brown's The Lost Symbol - has sold just 58,468 copies in the week to Saturday 19th December, a fraction of last year's top title, J K Rowling's The Tales of Beedle the Bard. The Harry Potter spin off saw sales of 159,337 in the same week, and seven other titles all sold more than 60,000 copies that week, a feat achieved by none this year. Nielsen BookScan has reported a book spend of £75.7m—up 9.6% week on week but down 8.2% on the same week last year. According to BookScan, £1.69bn has been spent at UK book retailers thus far in 2009, down just 1.2% year on year. However, on a rolling 12-month basis, sales are down just 0.1% to £1.75bn, meaning that with an extra day's trading this year the market could yet enter positive territory, with takings at UK book retailers this week expected to be much higher than the comparative week last year. Independent bookshops spoken to by The Bookseller have reported mixed trading in the run-up to Christmas. Alan Jeffery, co-owner of Hoddestone, said it would be difficult to tell how the season had been "until we close up on Christmas Eve", characterising trading as "volatile". "It got busier earlier in the month, but then last week it dropped off quite badly. It hasn’t matched up to last year, even though the beginning of December was much busier," he said. "It’s picked up again this week, despite the weather, but there’s still a way to go in terms of meeting last year’s figures. It’s so unpredictable at the moment, we just don’t know where we will end up." Jeffery said the shop had sold “surprisingly large amounts of hardbacks”, singling out Wolf Hall as particularly popular. Yesterday it was revealed that the title had become the bestselling Man Booker winner in the immediate aftermath of the prize victory since records began. He also cited classics, such as Peter Pan, and signed biographies – or those where the authors had come to the shop for an event – as strong sellers. Jack Dee, Simon King and Michael Palin had sold out at events, he said. "I think our [celebrity sales] would be down if we hadn’t held all these events," explained Jeffrey. "Some of the others aren’t shifting so fast." Vivian Archer of London-based Newham Bookshop, said it felt "flat". "Figure-wise it compares to last year, but these last three days haven’t been brilliant, and with the weather as it is, it’s really not helping. We had to close early yesterday (21st December) just to get home, because the snow was so thick.” She said classics – authors such as Charles Dickens, Leo Tolstoy, Oscar Wilde and Arthur Conan Doyle, many of which have been or are due to be given the film treatment – were all selling well, and the Vintage range generally had been popular. Although biographies have been down across the board, Archer also said signed books had sold very well. "We have sold Ant and Dec at full price, because the publishers have really supported us with signed copies," she said. "It’s not been our most important book, but it’s been more than we expected." Signed sporting biographies, of stars such as Freddy Flintoff, Serena Williams, Andre Agassi and Michael Vaughn had also sold well, as had Tony Benn's recently-published Letters to my Grandchildren. John Bailey of Cumbria-based Derwent Bookshop said customers were "holding out for bargains", and expected a rise in footfall as the deadline for deliveries from e-tailers nears. However, he also bemoaned the lack of strong titles, saying there were "very weak follow-ups". Bailey said: "There's too much Jeremy Clarkson, too much Top Gear stuff. There is a lack of innovation from publishers, they are just doing what supermarkets can sell lots of... It's a nightmare, a weak schedule from publishers having been lead by the nose by the supermarkets. They really need to get their acts together." Keith How at Bakewell said: "We haven't had the volume of people, but we are still busy despite four or five inches of snow . . . This is a piece published on 'The Bookseller' website today: MCR FAILS TO AGREE A BUYER FOR ANY BORDERS STORES Borders UK administrator MCR has failed to find a buyer for any of the retailer's 45 stores, resulting in the closure of every branch before Christmas. In a statement released late on Friday (18th December), the administrator said: "[D]espite pursuing a sale of the business it was not [sic] been possible to agree a sale of any part of the business as a going concern and therefore, as previously stated, all stores will formally cease to trade on 22 December 2009." Friday also saw a high court judge rule that MCR had been "incorrect" to sell Hachette UK titles after Borders went into administration without seeking permission first. The administrator had a day previously agreed to remove Hachette UK titles from sale in the stores. MCR must now pay all costs, and provide the publisher with an up to date list of which titles it has in stock. The administrator had previously said it was pursuing active negotiations with potential purchasers, with a document prepared by advisier Hilco for the administrator suggesting that as many as 23 stores could be sold. MCR said it was still in talks with potential buyers for assets of the business such as store leases, although this will not save any jobs.
